Thank you for considering me as your freelance 3D designer. I am committed to providing a dedicated service and ensuring a positive experience for all my clients. Please read the following terms and conditions carefully before making a booking. If you have any questions or concerns, please do not hesitate to contact me:
SCOPE OF ENGAGEMENT
The engagement will be limited to the services outlined and agreed upon by both parties, and will be performed in a professional and timely manner.
PRICING
Please note that my pricing structure is based on a day rate, and I do not provide quotes or fixed prices in advance of work. However, I can provide estimates based on the brief given. Design work can vary significantly in scope, and therefore, it is impossible to 100% accurately provide a fixed price. I will communicate with you throughout the project, so you are aware in advance of any additions to the estimate. I work at full capacity and am 100% committed to your project, so it will be completed as quickly as possible to the very best of my ability. I understand that your budget is incredibly important to you and your project. Please be assured that I will keep this in mind throughout the project and will do my best to ensure that we stay within the parameters of your budget as much as possible.
EXCLUSIVE COMMITMENT
Once a booking has been confirmed, I will be exclusively committed to providing the agreed-upon services to the best of my ability for the full length of the confirmed booking. In the event of unforeseen circumstances that prevent me from fulfilling a confirmed booking, I will do my best to inform the client as soon as possible and work with them to find a suitable solution.
CANCELLATION POLICY
In the event of cancellation of a confirmed booking by the client, the following fees and penalties will apply: Cancellations made 3 or more working days (72+ hours) before the booking date will not be charged. Cancellations made 2 working days (48 hours) before the booking date will be charged at 50% of the agreed day rate for the full length of the confirmed booking. Cancellations made within 1 working day (24 hours) of the booking date or after the booking has already commenced will be charged at 100% of the agreed day rate for the full length of the confirmed booking. The client agrees to pay any fees or penalties incurred as a result of such cancellation promptly. I reserve the right to pursue any legal remedies available to them in the event of non-payment or breach of contract.
PENCIL BOOKINGS
Clients may make a “pencil” booking to secure my availability for a specific date and time. However, please note that once a booking is confirmed, I will be exclusively committed to providing the agreed-upon services for that client for the full length of the booking. A pencil booking must be confirmed by the client at least 3 working days (72+ hours) before the booking date. If the client fails to confirm the booking within this timeframe, the pencil booking will be automatically cancelled.
I am dedicated to providing a high-quality service and will prioritize confirmed bookings over pencil bookings. If a conflict arises between confirmed and pencil bookings, I will prioritize confirmed bookings.
TERMINATION CLAUSE
Either party may terminate this engagement in writing in the event of a material breach of the terms and conditions contained herein. Additionally, the client may terminate this engagement at any time by providing written notice to the freelancer. The freelancer may terminate this engagement if the client breaches any material obligation under this agreement, fails to pay for services rendered, or engages in any conduct that the freelancer reasonably determines is inappropriate, including but not limited to harassment, discrimination, or unethical behaviour.
CONFIDENTIALITY
All information provided by the client will be treated as confidential and will not be shared with third parties without the client’s express written consent.
INTELLECTUAL PROPERTY
The client retains all rights to any intellectual property created during the engagement. However, I reserve the right to retain the 3D models and to include any work completed for the client in my portfolio or promotional materials, unless otherwise agreed upon in writing.
DESIGN AMENDMENTS
I will endeavour to see your project through to completion, including any design amendments. Depending on the scope, these may require full day bookings, however, more often than not, smaller amends can be done outside of working hours on evenings and weekends and will be charged pro rata. To efficiently make amendments and ensure a smooth design process, it is best for me to retain the working design files. However, if for any reason I am unable to fulfil these amends, I will supply all working files to the client, with the exception of any copyrighted items.
SCOPE CREEP AND COMMUNICATION
Regular communication between the client and myself is key to avoiding “scope creep,” which refers to any changes to the agreed-upon scope of work or any additional work required by the client that was not included in the initial agreement. Any change to the scope of work must be agreed upon in writing by both parties before work commences. I reserve the right to adjust the timeline or fee structure as necessary to accommodate any changes in scope.
PAYMENT TERMS
Payment is due within 30 days from the date of invoicing. Late payments may be subject to interest charges of 1.5% per month or the maximum legal interest rate, whichever is lower.
LIABILITY LIMITATION
In case of any damages or losses incurred by the client as a result of my services, my liability will be limited to the total fee paid by the client for the specific project or engagement. This clause does not apply to damages or losses caused by intentional misconduct or gross negligence on my part.
